Mouette, Inc. ("we", "us") sets out below the terms on which PinkyPromise (the "App") is provided (the "Terms"). By using the App, you are deemed to have agreed to the Terms.
Certificates created in the App have no effect as legal contracts. We take no responsibility for the promises themselves.
The Terms apply to every relationship between us and you arising from your use of the App. Any notices we separately publish within the App or on our website form part of the Terms.
The App is provided free of charge. It contains no in-app purchases and serves no advertising.
The App provides a way to record promises between users and to display and store them in the form of a certificate. Certificates, signatures, and other records created in the App have no effect as legal contracts.
We are not party to, and bear no responsibility for, the formation, content, performance, or non-performance of any promise between users. Any dispute between users shall be resolved by the users themselves, at their own responsibility and expense.
App data is stored only on your own device. See our Privacy Policy for details.
If data is lost through loss, failure, reset, or replacement of your device, through uninstalling the App, or for any other reason, we cannot recover it. Please export and keep anything you need, at your own responsibility.
You must not do any of the following when using the App:
The App is provided as is. We do not warrant that it is fit for your particular purpose, that it is free from defects, or that it will remain continuously available.
Except in cases of our willful misconduct or gross negligence, we are not liable for any damage arising from your use of, or inability to use, the App.
We may change the App or discontinue providing it without prior notice to users. Our liability for any resulting damage is limited as set out in the preceding section.
We may revise the Terms. A revised version takes effect when it is posted on this page. By continuing to use the App after that, you are deemed to have agreed to the revised Terms.
The Terms are governed by and construed in accordance with the laws of Japan. Any dispute between us and you concerning the App or the Terms shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of our head office as the court of first instance.
